Terms and conditions of sale

1. Scope

These terms and conditions of sale (the “Terms”) govern all catering, meal delivery and workshop services supplied by Emilios Sàrl, Rue Leschot 9, 1205 Genève, Switzerland (“Emilios”) to the client.

Confirming an order constitutes unreserved acceptance of these Terms. Any conflicting terms of the client apply only with Emilios' written consent.

2. Quotes and order confirmation

Prices shown on this website and totals calculated in the quote form are indicative. Only the written quote issued by Emilios is binding on the parties.

The order becomes firm once the client accepts the quote in writing and, where applicable, pays the deposit set out in art. 4.

  • The quote is valid for 15 calendar days from its issue date.
  • Orders must be placed at least 10 calendar days before the event.

3. Prices and VAT

Prices are stated in Swiss francs (CHF). Service, delivery, staffing and equipment-hire charges are itemised separately on the quote.

  • Emilios is registered for VAT. Food deliveries without a catering service are subject to the reduced rate of 2.6%, while catering or restaurant services are subject to the standard rate of 8.1%, subject to any change in the statutory rates. The applicable rate and VAT are shown on the quote.
  • Delivery charges outside the canton of Geneva are calculated according to distance and shown on the quote before confirmation.

4. Deposit and payment

Payment is made by TWINT using the link on the quote, or by bank transfer to the details shown on the quote. Emilios accepts no card payments through this website and stores no payment data.

  • A deposit is required only when specified in the quote; its amount and payment deadline are set out there.
  • The remaining balance is due within 30 calendar days after the client receives the invoice.
  • In the event of late payment, default interest of 5% per annum is due from formal notice, in accordance with art. 104 CO.

5. Changes to an order

Guest numbers and menu composition may be adjusted within the deadlines below. After those deadlines, the service is invoiced on the basis of the last confirmed guest count.

  • Any change to guest numbers must be notified no later than 5 calendar days before the event.
  • A variation of ±10% in guest numbers is accepted without a new quote.

6. Cancellation and postponement

Cancellations must be sent in writing to info@emilios.ch. Charges are calculated from the date the cancellation is received.

  • A cancellation received at least 7 calendar days before the event is free of charge, except for documented costs already incurred specifically for the order.
  • A cancellation received less than 7 calendar days before the event may be charged up to the full quoted amount.
  • Emergencies are considered case by case; any exception must be agreed in writing.
  • Any new date is subject to Emilios' availability. Costs already incurred and any price difference remain payable. If no new date is agreed, the cancellation terms apply.

7. Allergens and dietary requirements

The client must inform Emilios in writing, no later than order confirmation, of any allergy, intolerance or dietary requirement (halal, vegetarian, vegan, gluten-free, etc.).

Food is prepared in a kitchen that handles gluten, nuts, sesame, milk, eggs and fish among others. Emilios cannot guarantee the complete absence of cross-contamination and accepts no liability for an allergy that was not notified in writing.

The client is responsible for informing guests about the composition of the dishes served.

8. Delivery, setup and equipment

The client guarantees access to the delivery location and, where required, access to the water and electricity needed for the service.

Delivered food must be consumed on the same day. Emilios' responsibility for storage and temperature ends when the food is handed over to the client.

  • The delivery window, included waiting time and any additional waiting charges are agreed with the client and shown on the quote.
  • Platters, chafing dishes or other equipment may be loaned when listed on the quote. The client is responsible for returning them by the agreed deadline and for any loss or damage beyond normal wear and tear.

9. Liability

Emilios is liable for damage caused intentionally or through gross negligence. To the extent permitted by Swiss law, all other liability, in particular for indirect damage or loss of profit, is excluded.

For damage other than that caused intentionally or through gross negligence, Emilios' liability is limited to the amount invoiced for the service concerned, to the extent permitted by Swiss law.

10. Force majeure

Neither party is liable for non-performance caused by force majeure (natural disaster, order of a public authority, epidemic, major supply failure). The parties will then agree on a postponement or on a refund of amounts paid for the service not provided.

11. Data protection

Personal data provided with a quote request is processed in accordance with our privacy policy, available on this website.

12. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the Vienna Convention on the International Sale of Goods. Exclusive place of jurisdiction: Geneva, subject to any mandatory statutory venue.
